General

These General Terms of Sale exclusively govern sales made by Boisprive.fr through its website.

They are accessible on the website and will prevail, if necessary, in the event of a conflict of rules, on any other conditions, even those taken on a purchase order from the buyer.

The General Terms of Sale, applicable, are those in effect on the day the order is validated. They imply acceptance, prior and unreservedly.

Indeed, Boisprive.fr reserves the right to change at any time some of the provisions of its General Terms of Sale.

However, outstanding orders remain subject to the applicable conditions at the time the sale was completed.

How to order

Before validating the order, the customer declares that he became aware of and adhered to the General Terms of Sale in force on the day of the sale. Acceptance of these does not require a handwritten signature from the client.

You are required to provide specific data including the exact identity of the recipient of the order, the delivery and billing address, and the email address where a confirmation summarizing the order and the main provisions of these General Terms of Sale will be addressed to you.

Any order that could not be executed due to a delay due to the customer will result in billing.

In the event of cancellation of his order, the customer will be liable for an amount corresponding to the costs already exposed, plus an allowance of 20 of the amount ordered.

Invoices will be made to the invoice company informed at the time of the order.

Invoices can be accessed from the “My Account” section. They can be downloaded and printed.

price

Our prices listed on the website are all taxes included and are expressed in Euros.

These do not include delivery costs, which are calculated according to the destination and/or the desired delivery method. They will be listed before the final validation of the order and charged in addition to the price of the products purchased.

Boisprive.fr reserves the right to change its prices at any time, but undertakes to apply the rates in effect at the time the customer validates the order.

Payment

Payment is made by Credit Card (Visa, Mastercard) via our partner Stripe.

The order preparation will start the day after receiving all the necessary items (full payment of the order).

delivery

The products will be delivered to the delivery address indicated by the customer during the ordering process.

Delivery times are always given as an indication and cannot be considered contractual.

Nevertheless, we cannot be held responsible for the consequences of a delay in delivery or loss of parcels caused by a third party or by your fact or because of an unpredictable and insurmountable cause constituting a case of force majeure. The transfer of the risks of loss and deterioration of the products will be carried out from the outset of these products, the latter travelling at the risk and peril of the customer, who will be able, in case of damage, to make any complaints with the carrier under the legal and regulatory conditions in force.

On delivery, the customer is required to verify the compliance of the products ordered and delivered. It has three (3) days from receipt to notify Boisprive.fr, by letter recommended with notice of receipt, of all claims for non-compliance of the products delivered, with all the relevant documentation. After this period and failing to comply with these procedures, the products will be deemed compliant and free of any apparent defects and no claim can be validly accepted parBoisprive.fr

Return policy

In accordance with the Hamon Act in force, the customer has 14 days after receiving his order to retract.

Here are the return conditions:

For all products, the return costs are the responsibility of the buyer.

Unpacked, opened, used, tried or started products will not be accepted in return and therefore not refunded.

Force majeure

In the event of a force majeure to prevent the performance by Boisprive.fr of its obligations, it must inform the client by any means and as soon as possible. The performance of Boisprive.fr obligations will be suspended for the duration of force majeure.

In the sense of these General Terms of Sale, any event of any kind, reasonably beyond the control of Boisprive.fr, such as the action of the carrier or supplier, the strike, the termination or interruption of the means of transport regardless of the cause, strike or lockout in the industries or trades of essential and non-substitutable products involving , the shutdown or interruption of telecommunications networks or difficulties specific to telecommunications networks, the existence of legal or regulatory provisions affecting the marketing or distribution of products.

Miscellaneous provisions

All goods delivered remain the property of the seller until the buyer’s full payment of the invoice. However, it will bear the risk of loss, degradation or destruction of the goods delivered, from the start of our premises.

In the event that a stipulation of these General Terms of Sale is found to be in whole or in part null and void, this nullity will not affect the validity of these General Terms of Sale.

Failure by the customer to comply with the obligations under these Terms of Sale, and in particular regard to any incident of payment of the price of an order, may result in the suspension of access to the Boisprive.fr Service.

Accordingly, Boisprive.fr reserves the right to refuse any order from a customer with whom such litigation exists.

These General Terms of Sale are in French and are subject to French law.

In the event of a dispute, the client and Boisprive.fr will endeavour to resolve amicably and in the spirit of their agreements any difficulties that may arise in the interpretation or application of these agreements.

If they fail to do so, any dispute will, unless they agree otherwise, be referred to the competent courts under the conditions of common law.
